Terms and Conditions
Vertragsbedingungen für Bestellungen, Lieferung, Fahrzeugteile und technische Produktanwendungen.
Scope and seller
These Terms and Conditions apply to orders placed through the KAIZOR Motorworks online shop. The seller is Florian Schrank, trading as KAIZOR Motorworks, Schönau 125/1, 8225 Pöllau, Austria, email support@kaizor.at.
They apply to consumers and businesses. Mandatory consumer rights remain unaffected.
Contract formation
Product listings are invitations to place an order and are not binding offers. Customers can review and correct their cart and details before submitting an order. The order is accepted when we expressly confirm acceptance, send a dispatch confirmation, dispatch the goods or begin performance, whichever occurs first.
An automated receipt confirmation is not an acceptance unless it expressly says so. If an order cannot be accepted, we will notify the customer and refund payments already received.
Contract language and records
The contract language is German. This English interface and English translations are provided for easier understanding. Shopify product data and checkout content may remain in German. Where legally permitted, the German legal text prevails if translations differ.
Order and contract records are retained in accordance with legal requirements. Essential order information is sent by email.
Products and fitment
The agreed product characteristics follow from the product page, selected variant, specifications and stated scope of delivery. Technical fitment and road legality are separate assessments. A fitment indication is not a road-approval statement.
Vehicle-specific products must be checked against the exact vehicle configuration before permanent installation or modification. If required facts are unknown, no unconditional fitment promise is made.
Road use and installation
Products expressly marked for motorsport, track use or as not approved for public roads may only be used within the stated lawful purpose. The customer must check the rules applicable to the vehicle and country of registration.
Installation should be carried out according to the displayed installation level by a suitably qualified person or workshop. Mandatory warranty, damages and product-liability rights remain unaffected.
Prices, payment and shipping
Prices shown to consumers include applicable Austrian VAT unless clearly stated otherwise. Shipping costs and the final total are shown before the paid order is submitted.
Available payment methods, delivery countries and shipping methods are those displayed in the Shopify checkout. Delivery estimates appear on the product page, in checkout or in the order confirmation. A date is binding only if expressly agreed as binding.
Delivery and risk
For consumers, the risk of accidental loss or damage generally passes when the consumer or a nominated third party receives the goods. Reasonable partial deliveries are permitted without extra shipping charges caused by us.
Please report visible transport damage promptly so that we can assist and investigate with the carrier. A delayed report does not limit mandatory consumer rights.
Withdrawal and returns
Eligible consumers generally have a statutory 14-day right of withdrawal. Full conditions, exceptions, return-cost information and the model form are set out in the withdrawal information and Returns & Refunds page.
Custom-made or clearly personalised goods may be excluded from withdrawal where the statutory requirements are met.
Warranty
Statutory warranty rights apply. Consumers may rely on the mandatory conformity remedies and periods under applicable law. Additional manufacturer warranties apply only if expressly offered and do not replace statutory rights.
Liability
Liability is governed by mandatory law. Nothing in these terms excludes liability that cannot legally be excluded, including liability for intent, gross negligence, personal injury or mandatory product liability.
Complaints and dispute resolution
Complaints can be sent to support@kaizor.at. We are currently neither obliged nor generally willing to participate in proceedings before a consumer arbitration body unless legally required or agreed in a specific case.
Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection granted by the law of their habitual residence. Statutory consumer jurisdictions remain unaffected.
